All purchase orders placed with Bayside
Performance by either in person, phone, facsimile, internet (web) and/or
email constitute the acknowledgement and acceptance of all terms and conditions
listed below.
All IP addresses will be recorded by Bayside Performance for each completed web transaction. In the event of computer server/database encounters technical difficulties which may cause discrepancies with our product pricing, shipping calculations or sales tax computations Bayside Performance will correct these discrepancies at the time of processing. The customer will be notified by Bayside Performance immediately in the event of these errors and the customer will have the option to continue with the purchase order with the corrected amount or cancel the purchase order without penalty, except when the adjustment of the total amount of the purchase order reflecting sales tax no notification will be given. Bayside Performance will not be held responsible for any miscalculated totals due to server/database errors. All prices, product description, availability, materials, design, color, contents included with the product and/or product specifications are subject to change without notice. Some products may be displayed with optional items that are sold separately. Canadian and United States of America purchase orders can be expected within 1-10 business days from the time of full payment. International purchase orders can be expected within 6-14 business days from the time of full payment. Bayside Performance will notify the customer of any backordered product (s) longer than five (5) business days. If a customer has chosen an expedited shipping method, Bayside Performance does not guarantee that the purchase order (s) will be shipped by a certain date. It is the responsibility of Bayside Performance to collect the Harmonized Sales Tax for all purchase order (s) placed and shipped within British Columbia and to any Province that has HST. All other Canadian purchase order (s) will only be charged GST. Purchase order (s) placed and shipped outside North America will not be charged any taxes, it is the sole responsibility of the customer to pay any applicable taxes. The

Methods Purchase orders made by Credit Card and PayPal will only be shipped to a VERIFIED billing address, unless other arrangements are made by the customer contacting Bayside Performance. All pickup orders paid via Paypal or Credit Card must be signed for by the account holder unless other arrangements have been made prior to pickup. Other methods of payment (Cash, Debit, Money Order, Certified Cheque and wire transfers) for a purchase order(s) must be received in the full amount prior to Bayside Performance shipping the purchase order(s). Any unpaid orders will be held for thirty (30) days. After thirty (30) days, the unpaid purchase order will be cancelled and it will be necessary for the customer to re-order. Shipping

Exchange/Return Policy Product
Exchange/Return Policy Shipping costs of the returned product is the liability of the customer; Bayside Performance does not accept any collect on delivery (COD) shipments. The RA number must be clearly marked on the outside of the box; returns without the marked RA number will be refused and may be returned to the customer. All approved returns must received by Bayside Performance within ten (10) days of the RA number provided to the customer. All returned merchandise must be in its original manufacturer packaging with attached tags, instructions and unused condition. Both the product and packaging must be in good condition free from scratches, blemishes, tears or dents. It is the customer's responsibility to ensure the returning merchandise to Bayside Performance is adequately packaged, preventing any loss or damage to the returning product. All claims for missing products must be made by the end of the next business day upon the receipt of the purchase order, after that time Bayside Performance will not be liable for any shortages. All claims for damaged merchandise must be made to the shipping carrier; ensure that you keep all shipping cartons and all packaging materials for carrier inspection. It is the responsibility of the customer to initiate any claims with the carrier. All returned merchandise to Bayside Performance is subject to a 20% restocking fee. All canceled orders are subject to a 20% restocking fee if the item(s) have already been ordered. Any purchase orders that are refused and returned to Bayside Performance are deemed non-deliverable and subject to a restocking fee and all applicable shipping costs. Shipping and insurance costs are non-refundable. If a refund is approved by Bayside Performance, the reimbursement of money will be issued to the customer in the same monetary form as the payment was made to Bayside Performance at the time of the purchase. The
following are final sale items, no exchanges and no refunds: Warranty Liability The
products sold by Bayside Performance are intended for closed course use
only. Alteration or modifications of a motorcycle from its stock or original
manufacturer condition may increase the risk of accident or injury. Products
sold by Bayside Performance are not intended for street or highway use.
It is the sole responsibility of the customer to consult the federal,
provincial/state and local regulations which may apply to alterations
of your motorcycle. |
